1. Account Registration and Security

When creating an account with us, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you suspect any unauthorised access or security breach of your account, you must notify us immediately at info@01elements.com. We will not be liable for any loss or damage arising from your failure to comply with this requirement.

2. Acceptable Use Policy

You agree to use our services only for lawful purposes and in accordance with these Terms. You must not:

• Use the service for any illegal or unauthorised purpose, or in violation of any applicable laws or regulations in Hong Kong or elsewhere
• Upload, transmit, or distribute any malware, viruses, or other harmful software
• Scrape, crawl, or systematically extract data from our platform without prior written consent
• Interfere with or disrupt the integrity or performance of the service or its underlying infrastructure
• Attempt to gain unauthorised access to any part of the service or its related systems

3. User Content and Data

You retain full ownership of any content you submit, upload, or otherwise provide through our service ("User Content"). By providing User Content, you grant Binary Elements Limited a non-exclusive, worldwide, royalty-free licence to host, store, and process that content solely for the purpose of providing the service to you.

You are solely responsible for ensuring that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

4. Intellectual Property

All materials on this website — including but not limited to text, graphics, logos, software, design, and source code — are the exclusive property of Binary Elements Limited and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any part of our site or service without our prior written permission.

5. Fees and Payment

Payments for our services are processed through third-party payment providers (including but not limited to Stripe). By providing payment information, you authorise us to charge the applicable fees through such providers.

All fees are non-refundable unless otherwise expressly stated in a separate written agreement. We reserve the right to modify our pricing with at least 30 days' prior written notice to you.

6. Termination

We may suspend or terminate your access to the service immediately, without prior notice or liability, if you breach any provision of these Terms or engage in conduct that we reasonably determine to be harmful to other users, third parties, or our business.

Upon termination, your right to use the service will immediately cease.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Binary Elements Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or business interruption — arising out of or in connection with your use of (or inability to use) the service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to us in the three months preceding the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of HKSAR.
